By using the BRTH mobile application and brth.ch website (the "Service"), you agree to these Terms of Service ("Terms").
BRTH provides guided breathing exercises, meditation sessions, sleep tracking, and related wellness features. BRTH is not a medical device and does not provide medical advice. Consult a healthcare professional before use if you have respiratory or cardiovascular conditions.
You must create an account to use BRTH. You are responsible for maintaining the security of your account. We may suspend accounts that violate these Terms.
BRTH is available as a monthly (CHF 4.99) or yearly (CHF 44.99) subscription. New users receive a 14-day free trial. Subscriptions renew automatically and can be cancelled at any time. Payments are processed through Stripe in Swiss Francs (CHF). We reserve the right to change pricing with 30 days' notice.
You agree not to misuse the Service, attempt to access other users' data, reverse-engineer the application, or use automated tools to access the Service without authorization.
The Service and its content are owned by BRTH and protected by copyright. You are granted a limited, non-exclusive license for personal, non-commercial use.
You acknowledge that breathing exercises and meditation techniques involve inherent risks, including but not limited to dizziness, lightheadedness, hyperventilation, and loss of consciousness. You assume full responsibility for your use of the Service and agree to stop any exercise immediately if you feel unwell. The Service is not a substitute for professional medical advice, diagnosis, or treatment.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or accuracy of AI-powered analysis and feedback.
To the maximum extent permitted by applicable law, BRTH shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total cumulative liability for any claims arising from or related to the Service shall not exceed the total amount you paid to BRTH in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless BRTH and its affiliates from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
Your use of the Service is governed by our Privacy Policy.
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance.
These Terms are governed by the laws of Switzerland.
